IMPORTANT

This privacy policy applies to Level Consulting AG, Zurich (hereinafter referred to as “Level Consulting AG”).

In case of any contradictions between this privacy policy and other applicable contractual or business terms of Level Consulting AG concerning data protection, the provisions of this privacy policy shall prevail.

Data protection is of particular importance to the management of Culture Dynamics AG. With this privacy policy, we provide you with comprehensive information regarding the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, through this privacy policy, you as the affected individuals are informed about the rights you are entitled to. You will also have the opportunity to decide whether you consent to the processing of your personal data.

The processing of personal data, such as names, addresses, email addresses, or phone numbers of an affected individual, is always carried out in accordance with the applicable data protection regulations for Culture Dynamics AG.

Culture Dynamics AG, as the data controller, has implemented numerous technical and organizational measures to ensure a high level of protection for personal data processed by it or by those under its responsibility. However, internet-based data transfers may inherently have security vulnerabilities, meaning absolute protection cannot be guaranteed.

  1. Definitions

    Our privacy policy is designed to be easily readable and understandable both for the public and for our customers, business partners, and other affected individuals. To ensure this, we would like to explain the terms used in advance

    In this privacy policy, we use the following terms, among others:

    1. Personal Data

      Personal data is any information relating to an identified or identifiable natural person (hereinafter referred to as “data subject”). A natural person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

    2. Data Subject

      A data subject is any identified or identifiable natural person whose personal data is processed by the controller.

    3. Processing

      Processing is any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction.

    4. Restriction of Processing

      Restriction of processing is the marking of stored personal data with the aim of limiting its future processing.

    5. Profiling

      Profiling is any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning the person’s work performance, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

    6. Pseudonymization

      Pseudonymization is the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data cannot be attributed to an identified or identifiable natural person.

    7. Controller or Data Controller

      The controller or data controller is the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of processing personal data. Where the purposes and means of such processing are determined by applicable law, the controller or the criteria for its designation may be provided for in the applicable law.

    8. Processor

      A processor is a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the controller.

    9. Recipient

      A recipient is a natural or legal person, public authority, agency, or other body to whom personal data are disclosed, whether or not they are a third party. However, public authorities which may receive personal data in the course of a specific investigation under applicable law are not considered recipients.

    10. Third Party

      A third party is a natural or legal person, public authority, agency, or other body, other than the data subject, the controller, the processor, and the persons who, under the direct authority of the controller or the processor, are authorized to process personal data.

    11. Consent

      Consent is any freely given, specific, informed, and unambiguous indication of the data subject’s wishes, by which the data subject, either by a statement or a clear affirmative action, signifies agreement to the processing of personal data relating to them.

  3. Duration of Personal Data Storage

    The data controller processes and stores personal data of the data subject only for the period necessary to achieve the purposes for which the data were collected or as long as required by the applicable laws to which the data controller is subject, deemed necessary or appropriate

  4. Rights of the Data Subject

    1. Right to Confirmation

      Every data subject has the right to request confirmation from the data controller as to whether personal data concerning them is being processed..

    2. Right to Access

      Every data subject whose personal data is being processed has the right to obtain, at any time, free information about the personal data stored about them and a copy of such information. In particular, the data subject can obtain information about the following:

      • The purposes of processing
      • The categories of personal data being processed
      • The recipients or categories of recipients to whom the personal data have been or will be disclosed, particularly in the case of recipients in third countries or international organizations
      • If possible, the planned duration for which the personal data will be stored, or, if not possible, the criteria used to determine that duration
      • The existence of the right to rectification or erasure of personal data, or the restriction of processing by the controller, or the right to object to such processing
      • The existence of a right to lodge a complaint with a supervisory authority
      • wIf the personal data has not been collected from the data subject: all available information about the source of the data
      • dThe existence of automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and the intended consequences of such processing for the data subject

      Furthermore, the data subject has the right to be informed whether personal data have been transferred to a third country or an international organization. If this is the case, the data subject also has the right to be informed about the appropriate safeguards in place related to the transfer.

    3. Right to Rectification

      Every data subject whose personal data is being processed has the right to request the immediate rectification of inaccurate personal data concerning them. Furthermore, the data subject has the right to request the completion of incomplete personal data – including by means of a supplementary statement – considering the purposes of the processing.

    4. Right to Erasure (Right to be Forgotten)

      Every data subject whose personal data is being processed has the right to request the immediate erasure of personal data concerning them, provided one of the following reasons applies and processing is not necessary:

      • Dhe personal data were collected or otherwise processed for purposes no longer necessary.
      • The data subject withdraws their consent on which the processing was based, and no other legal basis for the processing exists.
      • The data subject objects to the processing under applicable law, and no overriding legitimate grounds for the processing exist, or the data subject objects to the processing under applicable law.
      • The personal data has been unlawfully processed.
      • The erasure of the personal data is required to fulfill a legal obligation under applicable law to which the controller is subject.
      • The personal data was collected in relation to services offered by the information society as per Article 8(1) of the GDPR.

      If the personal data have been made public by Culture Dynamics AG and the company, as the controller, is obliged to erase the personal data, Culture Dynamics AG will take reasonable steps, including technical measures, to inform other controllers processing the personal data, that the data subject has requested the erasure of all links to, or copies or replications of these personal data, unless processing is required.

    5. Right to Restriction of Processing

      Every data subject whose personal data is being processed has the right to request the restriction of processing by the controller if one of the following conditions applies:

      • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
      • The processing is unlawful, and the data subject opposes the erasure of the personal data and requests instead the restriction of their use.
      • The controller no longer needs the personal data for the purposes of processing, but the data subject requires it for the establishment, exercise, or defense of legal claims.
      • The data subject has objected to the processing under Article 21(1) of the GDPR, and it is yet to be determined whether the legitimate grounds of the controller override those of the data subject.
    6. Right to Data Portability

      Every data subject whose personal data is being processed has the right to receive the personal data concerning them, which they have provided to the controller, in a structured, commonly used, and machine-readable format. They also have the right to transmit these data to another controller without hindrance from the controller to whom the personal data have been provided, provided the processing is based on consent or contract and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
      Moreover, the data subject has the right, when exercising their right to data portability, to have the personal data transmitted directly from one controller to another, where technically feasible, and provided that this does not adversely affect the rights and freedoms of others

    7. Right to Object

      Every data subject whose personal data is being processed has the right to object, on grounds relating to their particular situation, to the processing of personal data concerning them, which is based on Article 6(1)(e) or (f) of the GDPR. This also applies to profiling based on these provisions.

      Culture Dynamics AG will no longer process the personal data in the event of an objection unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or the processing is necessary for the establishment, exercise, or defense of legal claims.

      If Culture Dynamics AG processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of their personal data for such marketing purposes. This also applies to profiling insofar as it is related to such direct marketing. If the data subject objects to the processing of their personal data for direct marketing purposes, Culture Dynamics AG will no longer process the personal data for these purposes.

      Additionally, the data subject has the right to object to the processing of their personal data for scientific or historical research purposes or statistical purposes in accordance with Article 89(1) of the GDPR, unless the processing is necessary for the performance of a task carried out in the public interest.

    8. Automated Individual Decision-Making, Including Profiling

      Every data subject whose personal data is being processed has the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning them or similarly significantly affects them, unless the decision is (1) necessary for the entry into or performance of a contract between the data subject and the controller, or (2) authorized by applicable law to which the controller is subject and such law provides for suitable measures to safeguard the rights and freedoms and the legitimate interests of the data subject, or (3) based on the explicit consent of the data subject.

      If the decision (1) is necessary for the entry into or performance of a contract between the data subject and the controller or (2) is based on the explicit consent of the data subject, Culture Dynamics AG will take appropriate measures to safeguard the rights and freedoms and the legitimate interests of the data subject, including at least the right to obtain human intervention, to express their point of view, and to contest the decision.

    9. Right to Withdraw Consent for Data Protection Purposes

      Within the framework of contractual and legal agreements, every data subject has the right to withdraw their consent to the processing of personal data at any time.

  5. Legal Basis for Processing

    Our company uses the Swiss Data Protection Act or, where applicable, Article 6(1)(a) of the GDPR as the legal basis for processing operations where we obtain consent for a specific processing purpose.

    If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, such as processing operations required for the delivery of goods or the provision of other services or benefits, the processing is based on the Swiss Data Protection Act or, where applicable, Article 6(1)(b) of the GDPR. The same applies to processing operations that are necessary for the execution of pre-contractual measures, such as in cases of inquiries about our products or services.n.

    If our company is subject to a legal obligation that requires the processing of personal data, such as fulfilling tax obligations, the processing is based on the Swiss Data Protection Act or, where applicable, Article 6(1)(c) of the GDPR.

    In rare cases, the processing of personal data may be necessary to protect vital interests of the data subject or another natural person. This would apply, for example, if a visitor were injured on our premises, and their name, age, health insurance data, or other vital information needed to be passed to a doctor, hospital, or other third parties. In this case, the processing would be based on the Swiss Data Protection Act or, where applicable, Article 6(1)(d) of the GDPR.

    Finally, processing operations not covered by any of the above legal bases may be based on the Swiss Data Protection Act or, where applicable, Article 6(1)(f) of the GDPR. This is the case when processing is necessary for the purposes of legitimate interests pursued by our company or a third party, provided that the interests, fundamental rights, and freedoms of the data subject do not override those interests.

  6. Legal or Contractual Obligations to Provide Personal Data; Necessity for Contract Conclusion; Obligation of the Data Subject to Provide Personal Data; Possible Consequences of Non-Provision

    We inform you that the provision of personal data may, in part, be required by law (e.g., tax regulations) or may result from contractual agreements (e.g., information about the contract partner). It may also be necessary for the conclusion of a contract that a data subject provides us with personal data that must subsequently be processed. For instance, the data subject is required to provide us with personal data if our company enters into a contract with them. Non-provision of personal data would result in the inability to conclude the contract with the data subject. Before providing personal data, the data subject may contact Culture Dynamics AG. Culture Dynamics AG will inform the data subject on a case-by-case basis whether the provision of personal data is legally or contractually required or necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and what consequences the non-provision would have.

  7. Existence of Automated Decision-Making

    As a responsible company, we refrain from automated decision-making.

  8. Purpose of Processing Personal Data

    Culture Dynamics AG vprocesses personal data of data subjects for various purposes. These purposes can be grouped into different categories. Specifically, we process personal data, wholly or in part, for one or more of the following purposes:

    Processing purposes related to our goods and service offerings:

    • Provision and sale of goods and services by Culture Dynamics AG.
    • Processing of orders and contracts, including sending order confirmations, shipping confirmations, delivery, and invoicing.
    • Organization and execution of events (courses, seminars, or training).
    • Organization and provision of customer service.
    • Organization and conducting of market research and surveys.
    • Checking customer creditworthiness.

    Processing purposes related to the implementation of customer projects in the role of a data processor:

    • Consulting customers regarding the handling of personal data.
    • Development of software solutions for processing, analyzing, and transforming personal data.
    • Support for customers in the operation of platforms that process personal data, including maintenance and troubleshooting, possibly also on productive systems
    • Data analysis based on customer requests.

    Culture Dynamics AG performs these tasks as much as possible based on pseudonymized and anonymized data.

    Processing purposes related to customer communication:

    • Provision, administration, and conduct of customer communication via post and electronic communication means.
    • Business communication via post and electronic means.
    • Analysis of the use of our offerings via phone and electronic means (e.g., type of use, frequency, and duration of use, exact location of use).

    Processing purposes related to the analysis of customer behavior:

    • Personalized and/or anonymous analysis of historical and current customer and purchasing behavior when using offerings on Culture Dynamics AG’s website, in social networks, etc.
    • Identification, classification, and analysis of current and potential customer needs and interests.
    • Statistical analysis of customer behavior based on anonymized customer data.
    • Linking newly collected personal data with data previously collected by us or connected companies.
    • Combining Culture Dynamics AG-collected data with that from affiliated companies or publicly available data and data acquired from third parties to enhance our data base and customer behavior analysis.

    Processing purposes related to direct marketing:

    • Simplifying processes (e.g., purchases or bookings) and using insights from customer behavior analysis to continually improve our goods and service offerings.
    • Avoiding unnecessary advertising through insights from customer behavior analysis for personalized direct marketing.
    • ZSending personalized advertisements by post or electronic communication means. Personalizing and customizing offers and advertising on our websites, mobile device apps, or platforms on internet portals and social media networks
  9. Disclosure of Personal Data

    Personal data of data subjects may be disclosed to affiliated companies of Culture Dynamics AG for the purposes mentioned in this privacy policy. These affiliated companies may use personal data for their own interests, such as personalized analysis of customer behavior and direct marketing activities. Within affiliated companies, employees will only have access to personal data as required for the performance of their duties.

    Personal data may also be disclosed to third parties to obtain technical or organizational services required for the fulfillment of the stated purposes or our other business activities. These service providers are contractually obligated to process the personal data exclusively on our behalf and according to our instructions. They are also required to comply with technical and organizational measures ensuring the protection of personal data.

    Personal data may be disclosed if required to comply with applicable laws and regulations, during legal proceedings, at the request of competent courts and authorities, or due to other legal obligations to protect and defend the rights or property of Culture Dynamics AG.

  10. Collection of General Data and Information

    Culture Dynamics AG collects personal data whenever contact is made with affected individuals.

    Personal data is collected under the following circumstances:

    • Visiting the business or other premises of Level Consulting AG and providing your personal data for further collaboration.
    • Purchasing goods or services in the business premises or via the website of Culture Dynamics AG
    • Using a service provided by the Culture Dynamics AG customer service.
    • Participating in Culture Dynamics AG events (courses, seminars, or training sessions).
    • Communicating with Culture Dynamics AG via phone or electronic means.

    The website of Culture Dynamics AG collects a range of general data and information every time an affected person or an automated system accesses the website. This general data and information is stored in the server’s log files. The data collected may include: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system arrives at our website (so-called referrer), (4) the sub-websites accessed via the system, (5) the date and time of access to the website, (6) an Internet Protocol (IP) address, (7) the Internet Service Provider of the accessing system, and (8) other similar data and information to aid in the defense against attacks on our information technology systems.

    When using this general data collected from website visits, Culture Dynamics AG does not draw conclusions about the affected individual. This information is primarily needed to (1) deliver the content of our website correctly, (2) optimize the content of our website and advertising for it, (3) ensure the permanent functionality of our information technology systems and website technology, and (4) provide necessary information to law enforcement agencies in the event of a cyberattack for prosecution purposes. Therefore, these anonymized data and information are analyzed by Culture Dynamics AG both statistically and with the goal of increasing data protection and data security in our company, ultimately ensuring an optimal protection level for the personal data we process. The anonymous data from the server log files is stored separately from any personal data provided by an affected individual.

  11. Contact Option via the Website

    The website of Culture Dynamics AG contains information required by law that allows quick electronic contact with our company as well as direct communication with us, which also includes a general email address. If an affected person contacts the person responsible for processing via email or a contact form, the personal data transmitted by the affected person is automatically stored. Such personal data voluntarily provided by an affected person to the responsible party will be stored for processing or contacting the affected person. No transfer of this personal data to third parties occurs.

  12. Subscription to Our Newsletter

    The website of Culture Dynamics AG provides users with the opportunity to subscribe to our company’s newsletter. The personal data transmitted to the responsible party when subscribing to the newsletter is detailed in the input form used for this purpose.

    Culture Dynamics AG informs its customers and business partners at regular intervals via a newsletter about the company’s offerings. The newsletter can generally only be received if (1) the affected person has a valid email address, and (2) the affected person has registered for the newsletter. A confirmation email is sent to the email address initially provided for the newsletter, in accordance with legal requirements, via the Double-Opt-In procedure. This confirmation email serves to verify whether the owner of the email address as the affected person has authorized the reception of the newsletter.

    When subscribing to the newsletter, we also store the IP address assigned by the Internet Service Provider (ISP) of the computer system used by the affected person at the time of registration, as well as the date and time of registration. The collection of this data is necessary to trace any possible misuse of an email address at a later time and thus serves to legally secure the responsible party..

    The personal data collected during the newsletter subscription process will only be used to send the newsletter. Subscribers may also be informed via email if necessary for the operation of the newsletter service or for related registration purposes, such as in cases of changes to the newsletter offering or alterations in technical conditions. No personal data collected as part of the newsletter service will be passed on to third parties. Subscription to our newsletter can be canceled by the affected person at any time. The consent to store personal data for the newsletter dispatch can be withdrawn at any time. A corresponding link for withdrawal is included in every newsletter. Furthermore, there is the possibility to unsubscribe from the newsletter directly on the website of the responsible party or to inform the responsible party in another way.

  13. Newsletter Tracking 

    The newsletters of Culture Dynamics AG contain technical methods that allow for the recording and analysis of log files. This enables a statistical evaluation of the success or failure of online marketing campaigns. Through these technical methods, we can determine whether, when, and how often an email has been opened by an affected person, and which links within the email were clicked by the affected person (including the time of opening and the frequency of opening).

    Personal data collected through the technical methods in the newsletters is stored and analyzed by the data controller to optimize the newsletter dispatch and better tailor the content of future newsletters to the interests of the affected person. This personal data will not be passed on to third parties. Affected persons are always entitled to revoke the specific consent given through the Double-Opt-In procedure. After a revocation, this personal data will be deleted. Unsubscribing from the newsletter will automatically be considered by Culture Dynamics AG as a revocation.

  14. Cookies

    The websites of Culture Dynamics AG use cookies. Cookies are text files that are stored on a computer system via an internet browser.

    Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters that allows websites and servers to be associated with the specific internet browser in which the cookie was stored. This enables the visited websites and servers to distinguish the individual browser of the affected person from other browsers that contain different cookies. A particular internet browser can be recognized and identified via the unique cookie ID.

    By using cookies, Culture Dynamics AG can provide users with more user-friendly services that would not be possible without setting cookies.

    Through a cookie, the information and offers on our website can be optimized in the interest of the user. As mentioned, cookies allow us to recognize users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, a user does not need to re-enter their login credentials each time they visit the website, as this information is taken from the cookie stored on the user’s computer system. Another example is the cookie for a shopping cart in an online store. The online store remembers the items a customer has placed in the virtual shopping cart through a cookie..

    Cookies are used for the following purposes:

    • Activating specific functions of a service (see §15)
    • Providing analyses (see §14)

    The affected person can prevent the setting of cookies by our website at any time through a corresponding setting of the internet browser used, and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time through an internet browser or other software programs. This is possible in all common internet browsers. If the affected person disables the setting of cookies in the internet browser used, not all functions of our website may be fully usable.

  15. Data Protection in Applications and the Application Process

    The data controller collects and processes the personal data of applicants for the purpose of processing the application process. The processing may also take place electronically. This is especially the case if an applicant submits corresponding application documents electronically, for example, via email or through a web form on the website, to the data controller. The transmitted data will be stored for the purpose of processing possible subsequent application procedures and for sending further information in compliance with legal regulations. Without an active objection from the affected parties, we assume their consent in this regard.

  16. Data Protection Provisions Regarding the Use of Google Analytics (with Anonymization Function)

    The data controller has integrated the Google Analytics component (with anonymization function) on the website of Culture Dynamics AG. Google Analytics is a web analysis service. Web analysis is the collection, gathering, and evaluation of data about the behavior of visitors to websites. A web analysis service collects data such as from which website a person arrived at the website (so-called referrer), which subpages of the website were accessed, or how often and for how long a subpage was viewed. Web analysis is primarily used to optimize a website and to conduct a cost-benefit analysis of online advertising.

    The operator of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

    The data controller uses the “_gat._anonymizeIp” addition for web analysis via Google Analytics. This addition shortens and anonymizes the IP address of the affected person’s internet connection when accessing the website of Culture Dynamics AG from a member state of the European Union or another state party to the Agreement on the European Economic Area.

    The purpose of the Google Analytics component is to analyze the traffic on the website of Culture Dynamics AG. Google uses the data and information gathered to evaluate the use of the website of Culture Dynamics AG, to compile online reports that show the activities on the website of Culture Dynamics AG, and to provide additional services related to the use of the website of Culture Dynamics AG.

    Google Analytics sets a cookie on the affected person’s information technology system. As already explained, cookies are text files. The setting of the cookie enables Google to analyze the use of our website. Each time an individual page of the website of Culture Dynamics AG, which is operated by the data controller and on which a Google Analytics component has been integrated, is called up, the internet browser on the affected person’s information technology system is automatically prompted by the respective Google Analytics component to send data for online analysis to Google. In the context of this technical procedure, Google becomes aware of personal data such as the affected person’s IP address, which Google uses, among other things, to track the origin of visitors and clicks and to enable commission settlements.

    Through the cookie, personal information, such as the access time, the location from which an access was made, and the frequency of visits to the website of Culture Dynamics AG by the affected person, is stored. With each visit to the website of Culture Dynamics AG, this personal data, including the IP address of the affected person’s internet connection, is transmitted to Google in the United States. This personal data is stored by Google in the United States. Google may share this personal data with third parties through the technical procedure.

    The affected person can prevent the setting of cookies by the website of Culture Dynamics AG, as already described above, at any time through a corresponding setting in the internet browser used and thereby permanently object to the setting of cookies. Such a setting in the internet browser would also prevent Google from setting a cookie on the affected person’s information technology system. In addition, any cookie already set by Google Analytics can be deleted at any time through the internet browser or other software programs.

    Furthermore, the affected person has the option to object to the collection of data generated by Google Analytics related to the use of the website of Culture Dynamics AG and the processing of this data by Google and to prevent it. To do so, the affected person must download and install a browser add-on at the following link: https://tools.google.com/dlpage/gaoptout This browser add-on communicates with Google Analytics via JavaScript, indicating that no data and information on website visits may be transmitted to Google Analytics. The installation of the browser add-on is considered an objection by Google. If the affected person’s information technology system is later deleted, formatted, or reinstalled, the browser add-on must be reinstalled by the affected person to deactivate Google Analytics. If the browser add-on is uninstalled or deactivated by the affected person or another person within their control, the option exists to reinstall or reactivate the browser add-on.
